Cao Yuanzheng: Adhering to Problem Orientation, Intensive Discussion, Organization and Coordination

On December 4, 2016, the Launching Ceremony of Green Legal Global Alliance & Seminar on "Building a Green Three-dimensional Legal Ecology Circle" sponsored and hosted by Beijing DOCVIT Law Firm kicked off in Beijing. Mr. Cao Yuanzheng, a famous economist and member of the Chinese Economists 50 Forum, delivered a video speech.

During the preparatory process, the representatives of the alliance had several discussions with me and consulted some opinions and suggestions. I think it's a good idea to set up a transdisciplinary alliance like the Green Legal Global Alliance. Today, I would like to talk with you about the orientation and operational mode of the alliance and questions related to the Research Institute.

I. Positioning of the Green Legal Global Alliance and Green Legal Global Alliance Research Institute

Green Legal Global Alliance is a platform which links with various industry resources, through the exchange and collision among industries, to find, extract and integrate problems, in order to seek and generalize the ways to solve the problems.

The Green Legal Global Alliance Research Institute is an important support and carrier of the alliance. It should be differentiated from the traditional research institutions, adhering to the problem orientation and focusing on medium instead of engaging in academic and macro research.

II. Operational mode

The Green Legal Global Alliance including Green Legal Global Alliance Research Institute should be run by progressive discussion, that is to say, through the understanding of the market, finding and extracting comprehensive issues which are valuable and cross-industry, inviting experts in a particular field to take the leadership in organizing and deploying resources for full guarantee, and through intensive and progressive discussions to achieve consensus, form conclusions, and to find and promote solutions. The operation process entails budget and evaluation, and project management is to be implemented.

To be specific, my advice has three points:

First, adhere to the problem orientation. The Research Institute should have a strong academic committee paying close attention to the market, understanding the market development stage, and raising problems, especially transdisciplinary comprehensive problems. In the case of PPP, this is a transdisciplinary comprehensive problem, involving various fields such as infrastructure and experts from various industries. After synthesis, problems will derive which will entail government participation, legal and capital support, and people's participation.

The transdisciplinary comprehensive problems are worth studying. This study is distinguished from those of professional research institutions and academic research in universities, also from the similar macro research to which the Chinese Economists 50 Forum pays attention. The study is called medium. The goal of problem-oriented research is to find solutions which should be proceeded from the perspective of overall thinking.

Second, the research by the Research Institute should be organized in the form of intensive discussion. First of all, it should be debated whether the problem can be regarded as a problem. To further think about what is the problem, and what is the core? Then, to consider how to integrate resources and organize manpower to research the problem. The organizational form is not like that of a conventional research institution which is already designed in advance. Instead, it may roll out with the problem.

In fact, what matters most is the promotion at the final phase. What we promote is concept, which is a consensus after repeated discussions as well as the most important problem.

Third, the core of the organizational structure should be organizational coordination, not research institutions. The organizational structure can be gradually defined in practice since it is difficult to predict the ultimate goal and direction for the moment. But one thing is certain, there is to be strong office staff to organize and coordinate related personnel to discuss problems. Alliance members should keep abreast of the views of all walks of life, understand the hot spots of the industry, and comprehensively analyze and identify problems.

Finally, it is suggested that two points should be planned in the alliance operation: First, what is the most promising industry in China? Two, what is the most problematic industry in China? After that, to determine the problem that we have the ability to solve, and to gradually form an outline after discussions presided over by experts. Budget and project management should be carried out in this process, the right of which should be in the charge of the platform responsible for determining whether it can be continued. The evaluation is to be conducted through meeting for the purpose of pooling more wisdom.

III. Organizational structure:

Based on the operational mode, I suggest that the organizational structure of the alliance can be made up of three parts: the Academic Committee, the Management Committee, and the Finance Committee. The three committees are to complete respectively three specific tasks, namely, project progress evaluation, project management and financial audit evaluation. Specifically:

The Academic Committee is responsible for holding the direction of researching problems and conducting academic evaluations. Generally it is divided into two levels. One is composed of more influential experts to grasp the macro and guide the research direction; the other is composed of the industry representatives who lead the various research topics. It is up to them to preside over research topics, evaluate the research process, and dock with the Management Committee and the Finance Committee.

The Management Committee is a day-to-day decision-making body which is responsible for the daily operation of the alliance. Its main responsibilities are to organize, deploy and integrate the resources of the platform and conduct project management.

The Finance Committee is mainly responsible for budgeting, auditing and other financial evaluations. 

The three committees do not have a crossover in personnel allocation and remain relatively independent.
